Legal System
In all of its jurisdictions, Malta’s legal system is primarily adversarial and is regulated by certain rules of procedure as outlined in the Criminal Code and the Code of Organization and Civil Procedure.
Although many components of the Maltese legal system were founded in the last century during the British occupation of the island, Malta’s legal system has held on to its civil law roots. Nevertheless, a number of principles have been introduced into Malta’s public law. Moreover, as a rule in the absence of a specific provision in the law, the principles of British public law are applied.
It has been said that Malta’s criminal law is the best example of a system that has successfully fused common and civil law principles. Malta’s Criminal Code, first ratified in 1854, was based upon the contemporary French and Italian Codes where substantive criminal law was concerned but used the English and Scottish rules for the purpose of criminal procedure.
Since its inception, several amendments have been added to the Criminal Code in an on-going attempt to keep the nation’s legislative conceptions of crime and punishment in line with contemporary legal philosophies. For example, at this time, the Code, the Constitution, and the European Convention on Human rights all regulate the concept of a fair hearing.
